About these Terms and Conditions

  • These Terms and Conditions apply when you make a purchase from Ephemie via our website or Etsy shop.

  • Our products are for the personal use of the buyer and may not be purchased for resale.

Prices and Product Descriptions

  • We are careful to ensure we visually represent our products as faithfully and accurately as possible, however due to differences in equipment and lighting conditions what you see on your screen or device may differ, and because of this we cannot guarantee that images are an accurate representation of the actual goods.

  • We take care to ensure that descriptions and details for a particular item are correct but human error may occur.

  • Prices are displayed in pound sterling £ GBP.

  • Prices do not include VAT and are not subject to VAT at present.

  • Product prices do not include delivery costs.

  • Delivery costs and options will be clearly identified during the checkout process and will be included in the Total Cost in the Order Summary in Checkout.

  • If we discover an error we will contact you immediately and give you the option of re-confirming your order with the correct details, or cancelling it.

Placing an Order

Browse:

  • To add a product to your basket: On a product page, select the quantity and click the ADD button.

  • To view or edit the contents of your shopping basket: Click on the shopping cart icon in the top right corner.

  • To proceed to checkout and view delivery costs: In the shopping cart, click on the CHECKOUT button.

Checkout:

  • Enter your contact email address and delivery address. Delivery prices will be displayed.

  • To proceed with your order, agree to Terms and Conditions of Sale, Privacy, and Delivery and Return policies.

  • Enter payment details.

  • The Order Summary will display Total Cost and a breakdown including delivery throughout the checkout process.

  • Opportunity to review policies before making final purchase.

Purchase:

  • Clicking on the PURCHASE button in checkout will place your order and our connected third-party payment processors will process payment.

Confirmation:

  • We will send you an Order Confirmation email when your order has been received and payment accepted. Please allow time for payment processing.

Payment

  • Payment is processed via third-party payment processors Stripe and PayPal, or Etsy, for your secure payment.

Delivery

  • Delivery costs and time estimates will be displayed in Checkout. Please also see Delivery and Returns.

  • Orders are dispatched the next business day and are delivered with Royal Mail Tracked services so you should be able to track your parcel. Delivery costs are based on current rates for your delivery address, and the size and weight of the parcel. Delivery time estimates are based on Royal Mail collection and delivery days, Monday to Saturday, excluding UK bank holidays.

  • We will send you an Order Dispatched email when your order has been dispatched, confirming estimated delivery time and providing you with a tracking number.

  • We will do our best to get items to you within the time estimate however, please note this is an estimate only and your items may be delayed due to circumstances beyond our control (such as a global pandemic/postal delays or bad weather).

  • Please enter your contact details and delivery address carefully. Products will be dispatched to the delivery address provided by the buyer. In case of error in the delivery address provided by the buyer, Ephemie cannot be held responsible for failure to deliver and cannot offer a refund unless the order is returned to us.

  • The buyer is responsible for any tax or import duty due on the order in the destination country outside of the UK.

Cancellation, Return and Refund

  • If you change your mind, you have the right to cancel your order. You may cancel and return item(s) to us any time after placing your order and within the 28 calendar days after your order is delivered.

  • Returns are free.

  • To cancel or return your order, please fill out the Cancellation/Return Request Form on the Delivery and Returns page. You do not have to provide the reason, though we would love it if you do as it may be helpful to us as a business.

  • If we receive your cancellation request before an item has been dispatched we will refund your order. Orders are dispatched the next business day.

  • If an item has already been dispatched or delivered you have 28 days to return the item(s) (the 28 days start the day after your order is delivered).

  • Products must be returned in their original condition, in original packaging, and undamaged from consumer handling. If an item is returned to us not in its original condition we are unable to give you a refund.

  • Personalised, bespoke or custom items cannot be returned.

  • Please retain your proof of postage until we can confirm we have received your cancelled and undamaged return item(s).

  • If item(s) arrive damaged, or there was a mistake in your order, please get in touch within 5 days of receipt with a description and photos to arrange a return or replacement.

  • If the whole order is being returned we will refund the cost of the order and the delivery cost. If only part of the original order is being returned we will refund the cost of the item(s) being returned.

  • Refunds can only be made to the original purchaser and to the original payment method. They will be made within 14 calendar days, or if you paid by card, within 5 - 10 business days.

  • We will send you a Refund Processed email confirming your return has been received and accepted and when you should expect to receive a refund.

  • If you do not receive your refund within 14 days please get in touch!

Liability

  • Sometimes things may go wrong but we will make our best efforts to avoid this. If something does go wrong please get in touch with us at our contact details above and we will do our best to resolve any issues for you.

  • Our products and services are provided on an 'as is' and 'as available' basis. Ephemie shall not be liable for any direct, special, indirect or consequential or incidental damages including loss of profit or loss of opportunity as a result of the use of or the inability to use any items that have been ordered on this website, or inability to access the website or our services, or any harm inherent in using the internet. We recommend that you protect your equipment by having appropriate anti-virus software in place when using any website, including ours.

  • You agree to indemnify Ephemie, its directors, officers, employees, consultants, agents, and affiliates, from any and all third-party claims, liability, damages, costs and expenses, including but not limited to legal fees, arising from your use or misuse of our website or our Etsy shop, or your breach of our Terms and Conditions.

  • Ephemie cannot be held liable for any failure to perform, or for any delay in performance of, our obligations to you that is caused by any event outside our reasonable control, deemed a Force Majeure Event. A Force Majeure Event includes but is not limited to strikes and industrial action, delays in delivery services, civil commotion, invasion, government legislation, total loss of stock, raw material or stock from a manufacturer or supplier no longer being available that Ephemie would not reasonably know about, extreme weather conditions, or any other event that we could not reasonably be prepared for or would prevent us from safely carrying out our obligations.

  • We will use our reasonable endeavours to minimise disruption caused by any Force Majeure Event, including (in our absolute discretion, and subject to availability) offering alternative products and services.

  • We retain the right to amend, remove or vary our services and/or any part of our website including our Terms and Conditions at any time.

Jurisdiction

These Terms and Conditions and our dealings with you shall be subject to English law and the exclusive jurisdiction of the English courts.
